Complex Assets

Many dissolutions of marriage or domestic partnership involve complex assets, such as retirement accounts, closely held corporations, or cash-based income.  These issues are ripe for inequitable outcomes between the parties.  To ensure a fair result, your attorney must be experienced in dealing with voluminous records and mysterious bank transactions.  This requires an attention to detail and an eye for inconsistencies in the bank records.

Father's Rights

Our office aggressively represents mothers, fathers, and grandparents (as third-party interveners). Under Oregon law, there is no preference given to a mother.  Consequently, fathers have an absolute right to contest custody and have a judge decide custody on the merits – in other words, deciding the best interests of the child.  There are several factors set forth in chapter 107 of the Oregon Revised Statutes that courts must follow to decide what is in the best interests.  You will find nothing in there about gender. 

Do not accept conventional wisdom about what the “judges usually do.”  While a friend’s anecdote is informative, every case is different, just as every judge is different.  The one thing that is consistent though is the law, and you are entitled to the best representation available to advocate your position.

Parenting Time

When you do not have the ability to be the sole custodian of the child, you need a fair parenting time plan that emphasizes reasonable contact with the child. Typically these matters can be resolved through the court mandated mediation program.  If the parties can work out the details of the parenting time on their own, it is often easier to live with and always more inexpensive than litigating it.
